             SAMPLE CLEARANCE FOR BEATS AGREEMENT

 

ALL SAMPLED BEATS ARE CREATIVE WORKS BETWEEN MYSELF & THE COPYWRITER OR PUBLISHER. HOWEVER, CLEARANCE IS YOUR RESPONSIBILITY AS THE ARTIST, AFTER BEAT PURCHASE OR LEASE, BEFORE SALE DISTRIBUTION!!!  I WILL ASSIST YOU WITH GETTING THE SAMPLED CLEARED.  A SPLIT SHEET WILL BE PROVIDED TO YOU AFTER PURCHASE OR LEASE.

How Sample Clearance Works

  • There are two types of sample clearances 

  1. Copyright to the Master Recording (Usually owned by the label so you need to get permission from the label to use it, or whoever owns the master recording.

  2. Next you have to get permission to use the underlying work..  Which is a separate copyright that protects the owner of the song directly, which is usually a songwriter or publisher.

 

  • Normally If you were doing just a “Cover” of a song then you wouldn’t need to ask permission.  You could just record your version of the song and pay a royalty to whoever has copyrights to the song.

 

  • With sampling, you need to get permission to use both the master recording and the underlying work.  

 

Challenges

  • Tracking down the copyright owners.  Finding them will be a big challenge because labels, publishers and catalogs are bought and sold all of the time.  And even once you find the owner there is no guarantee that they would want to talk to you.   

  • Even if you do get in touch with the copyright owners and they agree to let you use the sample, you still have to negotiate a fee.  

  • Most of the time there is an upfront fee.

  • On top of the upfront fee, they’ll want to negotiate a royalty.  That means that you’ll pay a percentage of whatever revenue is generated by the song to both the label and the publisher.
